Terms of Use – Qogni Technologies BV
1. Introduction
Welcome to Qogni! By using our services, you agree to these Terms of Use. This also includes our Privacy Policy and the GDPR Consent Form for Data Processing. These documents explain how we collect, process, and protect personal data.
By continuing with the onboarding process on the Qogni platform, you enter into a binding agreement with Qogni Technologies BV. If you do not agree, you must not use our services. If you wish to terminate the agreement, you can close your Qogni account.
2. Scope of Agreement
These terms apply to Qogni.com, the Qogni mobile applications, and related platforms, tools, and services. Users with an account are referred to as “User(s)”.
3. Responsibility and Data Management
Users within the EU, EEA, and Switzerland fall under Qogni Technologies BV. Their data is managed and stored within the European Union, on secure Microsoft Azure servers. Users outside these regions are also covered by Qogni Technologies BV unless stated otherwise.
Our Privacy Policy and Cookie Policy apply to all users.
4. Conditions of Use
- You are at least 18 years old or meet the local legal age requirements.
- You use your real name and only one Qogni account.
- You are not prohibited from using our services.
- Providing false information, especially regarding age or identity, is not allowed.
5. Account Management
You are responsible for keeping your password and account secure. Your account is personal, even when a service is paid for by your employer or an occupational health service. In such cases, an authorized third party (such as a case manager) may access certain summaries from Qogni Checks, strictly to provide targeted support.
Your employer will not have access to your personal answers or data.
6. Payments and Subscriptions
- You are responsible for all costs and applicable taxes related to paid features.
- Subscriptions automatically renew unless you cancel in time.
- Invoices are available in your account. Refunds are subject to our refund policy.
- Your payment details may be securely stored for future transactions.
7. Communication
- We may send you messages via the app or the email address you provided.
- You are responsible for keeping your contact information up to date.
- You can manage which messages you receive in your settings.
8. Content and Usage
- You retain ownership of the content you post but grant Qogni a non-exclusive license to use and display it within the platform.
- You are responsible for the legality of the content you post.
- Qogni reserves the right to remove or limit content when deemed necessary.
9. Service and Availability
- Qogni may modify, pause, or discontinue services at any time.
- We do not guarantee continuous availability or data storage.
- We are not a backup service.
10. Automated Processing
We use your data to personalize your experience, such as delivering relevant content or interventions. This processing is partially automated
11. Security and Storage
Your personal data is stored on secure servers within the EU (Microsoft Azure). We use encryption, access controls, and regular audits to safeguard your information.
12. User Rights
You have the right to access, correct, delete, and transfer your personal data. These rights can be exercised via your account settings or by contacting privacy@qogni.com.
Upon withdrawal of consent, your data will be deleted or anonymized in accordance with the GDPR.
13. Intellectual Property
All rights to the software, content, and Qogni branding remain the property of Qogni or its licensors. You may not use our brand name, logos, or elements without permission.
14. Usage Restrictions
You are not permitted to:
- Impersonate another person
- Use automation or scraping
- Bypass our security systems
- Share harmful, misleading, or illegal content
- Infringe on intellectual property rights
- Commercially exploit the platform without permission
15. Liability and Disclaimer
Qogni provides its services “as is.” We do not guarantee error-free operation. Our maximum liability is limited to the total amount you have paid to Qogni or €1,000, whichever is lower. This limitation does not apply in cases of intent or gross negligence.
16. Termination of Agreement
You may close your account at any time. Certain rights and obligations will remain in effect after termination, such as outstanding payments or content licensing.
17. Applicable Law and Disputes
These terms are governed exclusively by Dutch law. Disputes will be submitted to the competent court in Amsterdam.
18. Code of Conduct
As a Qogni member, you agree to behave positively and respectfully. We expect that you:
- Use your real identity
- Do not post misleading, harmful, or prohibited content
- Respect the privacy and rights of others
